The Constitution, 1996, is often described as transformative in its goal of replacing a race-based, sexist and authoritarian constitutional dispensation with one where the principles of non-racialism, non-sexism and the justification of power prevail.

In a short essay of between 500 and 750 words, motivate why you believe (or do not believe) that the aims of a ‘transformative constitutionalism’ are being achieved in South Africa.

Indicate the word count at the end of your essay and take note that your lecturer will not allocate marks for writing that goes over the 750-word limit. To answer this question, your starting point will be your prescribed textbook, in particular the discussions on transformative constitutionalism in chapters 2, 3 and 6 of Kleyn et al.
